Terms of Service

Thank you for using cwsi.net (the “Service”), a frequent flyer resource website that provides airline fare code charts, mileage calculators, flight lookup, and other aviation tools, operated by TechXperts, LLC (“CWSI”, “we”, “us”, or “our”).

PLEASE REVIEW THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, YOU SHOULD NOT USE THE SERVICE.

CWSI may revise these Terms from time to time. If CWSI does revise these Terms, the revised Terms will supersede prior versions. Revisions will be effective upon the effective date indicated at the top of these Terms, unless you have purchased a paid subscription to the Service, in which case such revisions will be effective upon the next renewal of your subscription. Your continued access or use of the Service constitutes your acceptance of any revisions. If you do not agree to the revisions, you should stop using the Service.

1. Definitions

“Account” means a registered user account on the Service.
“Content” means any data, text, information, or other materials displayed on or made available through the Service.
“User” or “you” means any individual who accesses or uses the Service, whether or not they have created an Account.
“Subscription” means a paid membership plan (e.g., Silver Club) that provides enhanced features and benefits.

2. The Service

2.1 Provision of Service

Subject to the terms and conditions of this Agreement, CWSI will make the Service available to you. If you create an Account, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your Account.

2.2 User Restrictions

You agree that you will not, directly or indirectly:

Reverse engineer, decompile, disassemble, modify, or create derivative works of the Service;
Attempt to probe, scan, or test the vulnerability of the Service, breach the security or authentication measures of the Service without proper authorization, or willfully render any part of the Service unusable;
Attack, or attempt to attack, the Service using a denial-of-service attack, a distributed denial-of-service attack, or any other attack;
Use or access the Service to develop a product or service that is competitive with CWSI’s products or services;
Use the Service to engage in any misleading or deceptive comparisons involving the Service or other products or services;
Use the Service to engage in any illegal activity, to infringe or violate any third-party rights, or otherwise outside the scope expressly permitted hereunder;
Scrape, crawl, or use automated means to extract data from the Service beyond what is permitted by our robots.txt file;
Share, transfer, distribute, resell, lease, license, or assign your Account or Subscription.

2.3 User Responsibilities

You will (a) be responsible for all use of the Service under your Account, (b) use commercially reasonable efforts to prevent unauthorized access to or use of the Service and notify CWSI promptly of any such unauthorized access or use, and (c) be responsible for obtaining and maintaining any equipment, software, and ancillary services needed to connect to, access, or otherwise use the Service.

2.4 Third-Party Products and Services

The Service may contain links to or integrations with third-party products and services (“Third-Party Products”), including but not limited to Stripe for payment processing, Google OAuth for authentication, FlightAware for flight data, and Google AdSense for advertising. Third-Party Products are governed by the applicable terms of their respective providers. CWSI does not endorse or support and is not responsible for Third-Party Products. You hereby waive any claims against CWSI with respect to any Third-Party Products.

3. Subscriptions and Fees

3.1 Free and Paid Tiers

The Service offers both free and paid subscription tiers. Free users may access basic features with certain limitations. Paid subscribers (e.g., Silver Club members) receive enhanced features as described on the Membership page.

3.2 Payment

All fees are quoted and payable in United States dollars. All payment obligations are non-cancelable and, except as expressly set forth herein, all fees paid are non-refundable. If you have selected a payment plan and provided your payment information, then you (a) represent and warrant that such information is true and that you are authorized to use the payment instrument, (b) will promptly update your account information with any changes to your payment instrument information, and (c) hereby authorize CWSI (including through its payment processor, Stripe) to bill your payment instrument in advance in accordance with the terms of the applicable payment plan.

3.3 Taxes

All applicable use, sales, and other similar taxes and government charges will be payable by you.

3.4 Cancellation

You may cancel your Subscription at any time through the Stripe Customer Portal accessible from your profile page. Upon cancellation, your paid features will remain active until the end of your current billing period.

4. Proprietary Rights

4.1 Ownership

CWSI exclusively owns all right, title, and interest in and to the Service, including all associated intellectual property rights. Except for the limited access rights expressly granted herein, no rights are granted to you and all rights in the Service are reserved by CWSI.

4.2 Feedback

You may from time to time provide CWSI suggestions or comments for enhancements, improvements, new features, or other feedback (“Feedback”). CWSI will have the full, unencumbered right, without any obligation to compensate or reimburse you, to use, incorporate, and otherwise fully exercise and exploit any such Feedback in connection with its products and services.

4.3 Aggregated Information

CWSI shall have the right to aggregate, collect, and analyze data and other information relating to the provision, use, and performance of the Service and shall be free to (i) use and retain such data and other information to develop and improve the Service and other CWSI offerings, and (ii) disclose such data and other information solely in an aggregated and anonymized format that does not identify you or any individual.

5. Disclaimers

THE SERVICE IS PROVIDED “AS IS” TO THE FULLEST EXTENT PERMITTED BY LAW. CWSI HEREBY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE IN RELATION TO THE SERVICE.

THE INFORMATION PROVIDED ON THE SERVICE, INCLUDING BUT NOT LIMITED TO AIRLINE FARE CODE CHARTS, MILEAGE CALCULATIONS, FLIGHT DATA, AND AIRPORT INFORMATION, IS FOR INFORMATIONAL PURPOSES ONLY. CWSI DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF THIS INFORMATION. AIRLINE POLICIES, FARE STRUCTURES, AND MILEAGE PROGRAMS CHANGE FREQUENTLY, AND YOU SHOULD ALWAYS VERIFY INFORMATION DIRECTLY WITH THE APPLICABLE AIRLINE.

CWSI IS NOT AFFILIATED WITH, ENDORSED BY, OR SPONSORED BY ANY AIRLINE OR AVIATION AUTHORITY. ALL AIRLINE NAMES, LOGOS, AND TRADEMARKS ARE THE PROPERTY OF THEIR RESPECTIVE OWNERS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, UNDER NO LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, WILL CWSI BE LIABLE TO YOU FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF USE, LOST PROFITS, OR INTERRUPTION OF BUSINESS, EVEN IF INFORMED OF THEIR POSSIBILITY IN ADVANCE, OR (B) ANY AGGREGATE LIABILITY IN EXCESS OF THE AMOUNTS PAID BY YOU TO CWSI DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Indemnification

You agree to defend, indemnify, and hold harmless CWSI, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any rights of a third party.

8. Termination

8.1 By You

You may stop using the Service at any time. You may delete your Account through your profile page.

8.2 By CWSI

CWSI may suspend or terminate your access to the Service at any time if you commit any material breach of these Terms. CWSI may also terminate or modify the Service at any time, with or without notice.

8.3 Survival

Upon expiration or termination of this Agreement, all rights and obligations will immediately terminate except that any terms or conditions that by their nature should survive such termination will survive, including terms relating to proprietary rights, disclaimers, indemnification, limitations of liability, and general provisions.

9. General Provisions

9.1 Assignment

You may not assign or otherwise transfer this Agreement without CWSI’s prior written consent. CWSI may assign this Agreement without consent to a successor to all or substantially all of its assets or business related to this Agreement.

9.2 Waiver

No waiver of any rights hereunder will be effective unless agreed to in writing by both parties. Failure or delay by either party to enforce any provision of this Agreement will not be deemed a waiver of future enforcement of that or any other provision.

9.3 Governing Law

This Agreement will be governed by the laws of the State of New Jersey, exclusive of its rules governing choice of law and conflict of laws.

9.4 Entire Agreement

This Agreement comprises the entire agreement between you and CWSI with respect to its subject matter, and supersedes all prior and contemporaneous proposals, statements, and agreements (oral and written).

9.5 Force Majeure

Excluding payment obligations, neither party will be deemed in breach hereunder for any cessation, interruption, or delay in the performance of its obligations due to causes beyond its reasonable control, including earthquake, flood, or other natural disaster, act of God, labor controversy, civil disturbance, terrorism, war, cyber attacks, or any change in or the adoption of any law, regulation, judgment, or decree.
